Apex court may fix hearing date for Najib and Nazifuddin’s IRB case appeal after Jan 2023

PUTRAJAYA (Nov 21): The Federal Court may fix the hearing date for former prime minister Datuk Seri Najib Razak and his son Datuk Nazifuddin Najib’s appeal regarding their RM1.69 billion and RM37.64 million income tax cases respectively after January next year.

This follows the apex court having fixed Jan 17 for case management of both cases, to possibly fix a hearing date for the appeal.

This was disclosed by Najib and Nazifuddin’s lawyer Wee Yong Kang, from Messrs Shafee & Co, to theedgemarkets.com following case management with the Inland Revenue Board (IRB) and the Federal Court on Monday (Nov 21) morning.

“The apex court has fixed Jan 17 to update the status of the grounds of judgement and to fix a hearing date,” Wee added.

On Sept 21, a three-member Federal Court bench led by Chief Justice Tun Tengku Maimun Tuan Mat had granted a stay of a summary judgement that was entered on Najib and Nazifuddin to pay the sum of RM1.69 billion and RM37.64 million respectively to the IRB, pending the disposal of their appeal to the apex court.

The CJ allowed the stay following no objections by the Malaysian government, which was represented by the IRB.

In October 2021, the Court of Appeal had upheld the decision of two separate High Courts in Kuala Lumpur that allowed the summary judgement to be entered against the father and son.

In May this year, the apex court granted leave to Najib and Nazifuddin to have their appeal over the summary judgement be heard on its full merits. However, no dates were fixed for the hearing at that time.

Hence, the hearing of the duo’s appeal will be decided based on nine questions of law posed and to be decided by the Federal Court.
