KUALA LUMPUR (Oct 28): Telekom Malaysia Bhd (TM) announced that the Court of Appeal has dismissed a lawsuit filed by Network Guidance (M) Sdn Bhd against it, and ordered the latter to pay costs of RM20,000 to TM, a filing by TM with the local bourse showed this evening.

Network Guidance, now known as Fine TV Sdn Bhd, had on Feb 11, 2011, sued TM and its then subsidiary TM Net Sdn Bhd, for an alleged breach of contract involving a joint venture agreement between TM Net and Network Guidance, and had sought RM23.65 million in special and general damages, with interests, costs and other reliefs, as deemed fit.

The suit was first dismissed by the High Court on Nov 7, 2012, on grounds that there is no binding JV agreement between the parties.

“As such, the allegation that says the first defendant [TM] had misrepresented the plaintiff [Network Guidance] that its network was able to deliver the VOD [video on demand] service, which had in fact induced the plaintiff to agree with the collaboration, must fail. Likewise, its claim for damages,” High Court judge Datuk Mohd Zawawi Salleh had said, in his written judgment then.

Going forward, TM said it will make an announcement on further developments.
